While the market availability for all-inclusive ski packages has shifted since the COVID-19 pandemic, select premium operators still provide these fully protected trips. Why has the market shifted away from offering a large choice of package holidays occured? To answer that question we first need to appreciate the basic consumer rights which go hand in hand with booking a 'package' holiday. Which then leads us onto the question, "What is a package holiday?"

In short, a package holiday has been created by a tour operator/holiday company when at least two travel elements (such as ski chalet, flights and resort transfers) have been combined and presented under one holiday booking invoice. Under the Package Travel and Linked Travel Arrangements Regulations Act of 2018 there are five basic consumer rights governed by English law (the most important being the first two):

By definition, then, a ski chalet holiday booking which includes a flight is a 'package' booking and therefore offers clients the financial protection and consumer rights as listed above.

Why are flight inclusive ski chalet packages harder to find post-COVID?

The reason why package holidays are less plentiful than in Pre-Covid Pandemic times is simple enough to answer. Small travel companies and tour operators, such as a ski chalet company, cannot afford to take the financial risk of another pandemic creating national and international travel bans. Because the 'Package Travel' regulations have not changed since they were created in 2018 (before the Covid pandemic). If a travel ban comes into force the holiday company cannot provide the holiday and is legally forced to give the client a full refund (as no alternatives are possible).

The issue for the travel company is that a) huge amounts of business will have been lost whilst the cost of creating that business (marketing and paying sales staff etc) will have already been endured, and b) accommodation suppliers such as hotels or chalet owners will already have been paid with no chance of monies being refunded to the travel company. Hence why the government forced travel bans cost package travel companies dearly. Many of those smaller chalet companies selling flight inclusive package holidays that were fortunate enough to financially survive those dark years no longer have the appetite for the finacial risk associated of selling a package holiday.

Today, by and large, it is the larger tour operators with significant parent/holding company financial backing that are prepared to take on the legal burden of selling a package holiday (eg Inghams, Crystal and Club Med). Bucking that trend, however, are still a few small, brave ski chalet companies such as Le Ski, Mark Warner, Ski Vertigo and Skiworld who still offer flight inclusive ski chalet package holidays.

As an Aside - The 'De Minimus' Rule: Does a hotel booking with transfers equal a 'package'?

It sounds like the opening of a riddle or joke, "When is a package not a package?". Interestingly a hotel stay combined with return resort transfers (but not including flights) is not considered a package holiday, despite being two travel elements joined together. ABTA guidance and English case law clarify that local minor transfers are treated as "minor transport services" rather than a standalone "carriage of passengers". For a transport element to count as a distinct component of a package, it cannot be an insignificant or minor addition to the main component (this is the De Minimis or Minor Service rule). Furthermore, as airport transfers are a practical necessity to get the client to and from the actual service they bought (the hotel accommodation) they are simply facilitating the primary service, and do not create separate travel arrangement in their own right.
